Terms of Service
Last updated: October 24, 2026
1. Acceptance
By using Member Pay, you accept these terms. If you do not agree, do not use the service.
2. What Member Pay is
Member Pay is a tool that lets you send payment reminders and payment links to your members or clients, and collect those payments via Stripe.
3. Your Stripe account: you are the merchant
Member Pay uses Stripe Connect "Standard" accounts. This means your business, not Member Pay, is the official merchant for every payment processed. Specifically:
- Stripe's fees are yours, billed directly by Stripe to your account, at Stripe's rates.
- Payment disputes (chargebacks) and refunds are entirely your responsibility, handled directly between you and Stripe. Member Pay does not step in to decide these and has no access to override them on your behalf.
- Funds are paid out directly to your Stripe account, on Stripe's payout schedule, not one set by Member Pay.
- Member Pay deducts a 1% application fee on each successful payment processed
through our platform (an
application_fee_amountwithheld by Stripe at the time of payment). This fee is in addition to Stripe's standard fees, not instead of them.
4. Your obligations
- You must have a legitimate right to bill the people you send a payment link to.
- You may not use Member Pay to send unsolicited communications to people who owe you nothing or have no existing business relationship with you.
- You are responsible for the accuracy of the amounts and contact information you enter.
5. What we can do if an account is used abusively
To protect our sending domain's reputation and our other customers, we may temporarily suspend reminder sending for an account if we observe a high volume of complaints, bounces, or signs of abuse, while we clarify the situation with you.
6. Service availability
We aim for high availability but do not guarantee uninterrupted service. Member Pay is not liable for losses arising from a service interruption, to the extent permitted by law.
7. Termination
You may close your account at any time. We may terminate or suspend an account for violation of these terms, fraud, or abuse.
8. Limitation of liability
To the extent permitted by law, Member Pay's liability to you is limited to the application fees you paid us in the three months preceding the claim. Member Pay is not liable for disputes, refunds, or decisions made by Stripe regarding your merchant account.
9. Governing law
These terms are governed by the laws of the Province of Quebec and applicable laws of Canada.
